The https://apresmahjong.com/ website is owned and operated by Apres Mahjong LLC (“Apres Mahjong,” “we,” “our,” or “us”). These Website Terms of Use (“Terms”) are intended to make you aware of the terms and conditions of your use of our website and any related content or information therein (the “Site”). 

We reserve the right to update and modify these Terms at any time without prior notice. Any modifications to these Terms will be effective immediately upon posting of the updated Terms on the Site. Your continued use of the Site following a notice of updated Terms constitutes your acceptance to be bound by any changes. 

1. SITE GENERALLY; PROHIBITED USES.
   1. Site Generally. By accessing the Site, you represent and warrant that you are legally permitted to use and access the Site and take full responsibility for your access, selection, and use of the Site.
   2. License Grant. Subject to the other provisions of this Agreement, Apres Mahjong grants to you a non-transferable, non-exclusive, worldwide limited right to access and use the Site for your personal, household, or commercial purposes. You may use the Site only for lawful purposes and in accordance with these Terms. 
   3. Content on the Site. The content we provide on the Site is not guaranteed to be accurate and may contain errors or omissions. We reserve the right to update and modify such content at any time and at our discretion.
   4. Right to Modify. Apres Mahjong reserves the right, in its sole discretion and without prior notice, to change, modify, discontinue, terminate, or suspend all or part of the Site or any service or offering described on the Site. Apres Mahjong will not be liable if, for any reason, all or any part of the Site is unavailable at any time for any period. 
2. FEEDBACK. You hereby agree to assign and hereby assign to Apres Mahjong any right, title, and interest in and to any feedback, suggestions, ideas, enhancement requests, or other similar input

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ANY OFFERING (E.g., ANY EVENT, LESSON, OR SERVICE) WE OFFER OR PROVIDE IS PROVIDED “AS IS” AND “AS AVAILABLE,” AND AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY LAW, APRES MAHJONG EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. APRES MAHJONG MAKES NO WARRANTY THAT THE SITE (INCLUDING ANY RELATED CONTENT) OR OFFERING WILL MEET YOR REQUIREMENTS; THAT USE OF THE FOREGOING WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR FREE; THAT CONTENT FOUND ON THE SITE WILL BE ACCURATE OR RELIABLE; THAT DEFECTS IN THE OPERATION OR FUNCTIONALITY OF OUR SITE WIL BE CORRECTED; THAT THE SITE AND ANY CONTENT ON THE SITE WILL BE VIRUS-FREE; OR THAT THE QUALITY OF ANY CONTENT OBTAINED THROUGH THE SITE WILL MEET YOUR EXPECTATIONS. ANY CONTENT DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE SITE IS DONE AT YOUR SOLE RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE THAT RESULTS FROM THE DOWNLOAD OF SUCH CONTENT.
4. LIMITATION OF LIABILITY. Limitation of Liability. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL APRES MAHJONG, OR ITS OFFICERS, DIRECTORS, OR EMPLOYEES BE LIABLE FOR DAMAGES (INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES), OF ANY KIND ARISING OUT OF OR RELATED TO YOUR ACCESS OF, USE OF, OR INABILITY TO ACCESS OR USE, THIS SITE OR OTHER WEBSITES TO WHICH IT LINKS (INCLUDING THIRD-PARTY MATERIALS) OR ANY RELATED OFFERINGS. THIS INCLUDES, BUT IS NOT LIMITED TO, CONTENT DOWNLOADED FROM THIS SITE OR OTHER LINKED WEBSITES, APPLICATIONS, FORMS OR OTHER RESOURCES OR MATERIALS THAT APPEAR TO YOU OR ARE CONSTRUED BY YOU TO BE OBSCENE, OFFENSIVE, DEFAMATORY, OR INFRINGING ON YOUR INTELLECTUAL PROPERTY RIGHTS. IN NO EVENT WILL APRES MAHJONG OR THIRD PARTIES THAT CONTRIBUTE INFORMATION TO THE SITE BE LIABLE TO YOU OR ANYONE ELSE FOR ANY DECISION OR ACTION TAKEN BY YOU IN RELIANCE OF SUCH INFORMATION, EVEN IF WE HAVE BEEN ADVISED OF OR ARE AWARE OF THE POSSIBILITY OF THESE DAMAGES. TO THE EXTENT THE FOREGOING IS NOT APPLICABLE OR ENFORCEABLE UNDER APPLICABLE LAW, OUR TOTAL LIABILITY AND YOUR EXCLUSIVE REMEDY UNDER OR RELATED TO THESE TERMS AND THE SITE PROVIDED IS LIMITED TO DIRECT MONEY DAMAGES NOT EXCEEDING TEN US DOLLARS ($10) OR THE AMOUNTS YOU PAID US FOR OUR OFFERINGS. THE EXISTENCE OF MULTIPLE CLAIMS DOES NOT ENLARGE THE LIMIT. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL APRES MAHJONG BE LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL, INDIRECT, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, LOST PROFITS OR REVENUE OR LOST OR DAMAGED DATA, WHETHER ARISING IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, EVEN IF WE ARE AWARE OF THE POSSIBILITY OF SUCH LOSS OR DAMAGES.
5. MISCELLANEOUS.
   1. Exclusions and Local Laws. Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Furthermore, mandatory local consumer protection laws, which these Terms do not replace or exclude, may offer you legal rights and remedies in addition to the rights and remedies provided to you under these Terms. Accordingly, some of the above limitations and disclaimers may not apply to you. To the extent that Apres Mahjong may not, as a matter of applicable law, disclaim any implied warranty or limit its liabilities, the scope and duration of such warranty and the extent of Apres Mahjong’s liability 
   2. Disputes. These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of laws principles. The parties agree to be subject to the exclusive jurisdiction of the appropriate state or federal courts in the State of Utah in connection with any dispute or action relating to these Terms, with venue for any such action to be in Utah.
